Dog owners in Ontario are responsible for the actions of their dogs. The Dog Owners’ Liability Act governs and provides that an owner is responsible for a bite or attack by the dog on a person or animal. This “strict liability” does not require the owner to have done anything wrong, nor does it require the owner to have previous knowledge of aggressive behaviour on the part of the dog.
The owner’s responsibility can be reduced by “contributory negligence” if the person who was hurt was partly at fault. For example, if someone provoked a dog or didn’t heed an owner’s warning to stay away. A Court might find the person bit to be, for example, 30% at fault, which would reduce the dog owner’s liability (and the amount he/she has to pay) by 30%.
If you are a dog owner, it is important to understand your responsibility for your dog’s behaviour. Even if you are a responsible owner and believe you are doing everything right, if something goes wrong and your dog bites or attacks another person or dog, you are responsible for the actions of your dog. Obviously, good training and knowing your dog’s temperament are important.
