Some readers from Ontario may have an interest in event hosting. While such activities can indeed be fun for those involved, it may also be important to take a few precautions to protect oneself from liability in case of an incident. In general, it is the responsibility of the host to ensure the safety of patrons on the premises.
One of the most common forms of liability that can arise out of event hosting is related to the underage consumption of alcohol. Those under the age of 19 should not be invited to an event where alcohol is to be served unless an adult over the age of 25 accompanies them. Moreover, even if accompanied by an adult, a minor should not be served alcohol.
Similarly, a host is responsible for arranging for the safe transportation of his or her patrons after the event ends. Any costs related to that endeavour, such as paying for someone’s taxi, may be borne by the host. In some cases, a host is required to remain on the premises of the event until all patrons have safely vacated the area. If alcohol consumed prior to an accident involving a drunk driver is connected to an event the driver attended earlier, its host could potentially be found to partially share in their liability.
If someone is being accused of a matter related to premises liability, they may wish to consult with a lawyer about their case. A lawyer may help someone to assemble evidence that mitigates their liability as much as possible by showing that they acted responsibly. In addition, a lawyer might be able offer counsel with respect to avoiding potential liability issues while an upcoming event is being planned.
