Unfortunately, all too often, there are incidents at bars and nightclubs which involve staff (typically bouncers, but not always) assaulting patrons.
These establishments (taverns) are subject to very specific rules when it comes to the service of alcohol and the use of force. Staff must be Smart Serve certified and are responsible for ensuring that customers are not over-served. Security staff (bouncers, doormen) must be trained and licensed and their training includes specific training in the appropriate use of force.
Often, in the case of an assault by a bouncer or doormen, the bar will claim that the customer was intoxicated or provoked staff. That is not a defence, particularly where the establishment over-served. Even in the case of provocation, security staff must take care not to use excessive force. Police officers are not allowed to use excessive force, so why should a doorman or bouncer have that level of power?
If you have been injured as a result of an assault by a bouncer, doorman or other staff, or suffered injury as a result of over-service, the lawyers at Burn Tucker Lachaîne may be able to help you recover damages.
